- Maintain ownership or proper licensing rights for all content, trademarks, logos, images, and intellectual property supplied to Buddy Mail Advertising.
- Obtain all required permissions and consents for marketing activities.
Buddy Mail Advertising shall not be responsible for errors, delays, compliance violations, or additional costs resulting from inaccurate information, incomplete submissions, or delayed approvals.
4. Quotes, Orders, and Payment
All estimates and proposals are subject to change unless otherwise stated in writing.
Production, mailing, or advertising services may require deposits or full payment before work begins.
Invoices are due according to the terms stated on the invoice. Overdue balances may incur interest charges, collection fees, and suspension of services.
The client remains responsible for all production, postage, media, platform, and third-party costs incurred on their behalf.
5. Mailing Lists and Data Usage
Buddy Mail Advertising may provide mailing lists, data services, demographic targeting, and audience segmentation.
Unless otherwise agreed in writing:
- Mailing lists are licensed for one-time use only.
- Lists may not be copied, sold, shared, transferred, or reused.
- Data counts are estimates and may vary.
- No guarantee is made regarding deliverability, accuracy, response rates, or campaign performance.
Clients agree to use all data in compliance with applicable privacy, consumer protection, and marketing laws.
6. Direct Mail Compliance
Clients are solely responsible for ensuring that their offers, advertisements, promotions, and marketing claims comply with all applicable federal, state, and local laws.
Buddy Mail Advertising reserves the right to reject any campaign that may violate legal, postal, advertising, or ethical standards.
Clients agree to indemnify Buddy Mail Advertising from any claims, fines, penalties, or damages resulting from campaign content provided by the client.
7. SMS Communications and Consent
Where applicable, Buddy Mail Advertising may offer SMS messaging services, notifications, marketing communications, or campaign management involving text messaging.
By providing your mobile phone number and opting in, you consent to receive text messages from Buddy Mail Advertising.

Clients assume full responsibility for compliance related to contact acquisition, consent collection, and message content.
8. Email Marketing Compliance
Clients using email marketing services are responsible for ensuring compliance with applicable laws, including the CAN-SPAM Act and related regulations.
Buddy Mail Advertising may refuse campaigns that appear deceptive, misleading, fraudulent, or otherwise non-compliant.
9. Production, Printing, and Delivery
Production schedules, mailing dates, and delivery estimates are approximate and may be affected by:
- Client approval delays
- Vendor production schedules
- Material shortages
- Postal processing times
- Carrier delays
- Weather events
- Force majeure events
Buddy Mail Advertising shall not be liable for delays caused by printers, carriers, postal services, software providers, or other third parties.
10. No Guarantee of Results
Marketing outcomes depend on numerous variables beyond our control.
Buddy Mail Advertising does not guarantee:
- Response rates
- Lead volume
- Website traffic
- Conversion rates
- Sales volume
- Revenue increases
- Return on investment
- Search engine rankings
- Advertising performance

13. Website Use
Users agree not to:

16. Indemnification
Clients agree to defend, indemnify, and hold harmless Buddy Mail Advertising, its owners, employees, contractors, affiliates, and agents from any claims, damages, liabilities, penalties, costs, and expenses, including reasonable attorney fees, arising from:
- Client-provided content
- Client marketing practices
- Regulatory violations
- Intellectual property claims
- Privacy law violations
- SMS or email compliance violations
- Misrepresentations made by the client
17. Privacy Policy
Your use of this website is also governed by our Privacy Policy, which is incorporated into these Terms and Conditions by reference.
18. Arbitration and Dispute Resolution
Any dispute arising from these Terms or the services provided by Buddy Mail Advertising shall first be submitted to good-faith mediation.
If mediation is unsuccessful, disputes shall be resolved through binding arbitration in the State of Utah under the rules of the American Arbitration Association.
Each party shall bear its own legal fees unless otherwise awarded by the arbitrator.
The parties waive any right to participate in class-action litigation or class-wide arbitration.
